OFFICIAL RULES 2008 Garden Fresh 30 Remarkable Guests Essay Contest
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Eligibility: The 2008 Garden Fresh 30 Remarkable Guests Contest ("Contest") is open to legal residents of the fifty United States and the District of Columbia who are aged 18 years or over at the time of entry. Employees of Sponsor and/or its advertising, promotion and production agencies and their immediate family members living in the same household are not eligible to participate in the Contest or receive a prize.
2. How to Enter: Visit a participating Sweet Tomatoes or Souplantation restaurant in the United States during normal business hours from July 1, 2008 through July 31, 2008 (the "Promotion Period") and obtain and fill out an official entry form (while supplies last); hand print your name, birthdate, address, phone number, and location of the Sweet Tomatoes or Souplantation restaurant you visit at the bottom of a piece of paper sized 8-1/2"x11"; or print out an official entry form available on Sponsor's website at www.souplantation.com and fill out the requested information (each an "Entry Form"). In 200 words or less, describe why you, or someone you know, deserves to be one of our 30 Remarkable Guests. Share experiences, memories, routines, traditions, and anything else that would make a remarkable guest. Limit one page per Entry (including front and back), no attachments or additional pages will be accepted. You may deposit your Entry in the entry box located at a participating Sweet Tomatoes or Souplantation restaurant during regular business hours during the Promotion Period. You may also mail your Entry to "2008 Essay Contest Entries" c/o Garden Fresh Restaurant Corp., 15822 Bernardo Center Drive, Suite A, San Diego, CA 92127-2320. Essay must: (1) be completely original, of entrant's own writing style and creation; (2) be solely created and written by the entrant; (3) not have been submitted in other contests or won previous awards; (4) not infringe the rights of any third party (for example, the Entry must not be copied from another essay); and (5) not be offensive or defamatory, as determined by Sponsor in Sponsor's sole discretion. Sponsor is not responsible for late, lost, damaged, mutilated, illegible, stolen, incomplete, misdirected or postage-due Entries or mail or for address changes of entrants. Entries deemed Illegible or incomplete by Sponsor in its sole discretion will be disqualified. Entries become the property of the Sponsor and will not be returned. Onsite entries must be received in an official entry box at a participating location by Sponsor by the end of business on July 31, 2008, and mail-in entries must be postmarked by July 31, 2008 and received by August 11, 2008. Proof of sending will not be deemed to be proof of receipt by Sponsor. Limit: One entry per person.
3. Judging: All Entries will be judged by Sponsor or its designee, the judge of the Contest, whose decisions are final on all matters relating to the Contest. Each Entry will be judged according to the following criteria: (1) Originality/Creativity (50%), (2) Appropriateness to Subject Matter (20%), Composition (20%), and (3) Sincerity (10%). The thirty entrants whose essays earn the highest overall scores will win. In the event of a tie, the entrant with the highest score in the Originality/Creativity category will be deemed the higher(est) scoring entrant as between or among the tied entrants. Winners will be notified by telephone on or about September 1, 2008. Return of any prize notification or prize as undeliverable will result in disqualification and selection of an alternate winner. Sponsor and its agents are not responsible for lost, late, stolen, illegible, incomplete, damaged, destroyed, postage due or misdirected entries or mail or email communications. No mechanically reproduced entries allowed. An entrant is not a winner unless and until the entrant's eligibility and the potential winning entry have been verified and entrant has been notified that verification is complete. Potentially winning entries will be verified by Sponsor, whose decisions to the administration and operation of the Contest and the selection and validation of potential winners are final and binding in all matters related to the Contest. Use of a false email account or an incorrect mail address will disqualify an entry. Winner will be required to and by entering hereby agrees to sign and return an affidavit of eligibility, liability/publicity rights releases except where prohibited, and an assignment of all rights, including copyright, concerning the essay in the Entry, all to be received by Sponsor within 14 days of the date of notification or prize will be forfeited and awarded to an alternate winner.
4. Prizes and Odds: There are thirty (30) prizes, each consisting of thirty (30) "free passes," each redeemable for one complimentary lunch or dinner, beverages excluded, at your choice of participating Souplantation restaurants or participating Sweet Tomatoes restaurants (total ARV of all prizes $3960.00). There is also a chance that Sponsor will feature your essay on Sponsor's website and/or in other advertising or promotional materials for Sponsor. Use of winning essays for any promotional purposes is not guaranteed. No prize substitutions or cash equivalents, except at the sole discretion of the Sponsor if an advertised prize becomes unavailable. Prizes are non-transferable. Prizes may not be redeemed for cash or combined with other offers. All taxes and any expenses in connection with the receipt and use of prizes are the sole responsibility of the winner. Odds of winning depend on number of eligible entries received. One (1) prize per person, household or family.
5. General: Sponsor and its affiliates, subsidiaries, representatives, advertising, promotion and publicity agencies are not in any way responsible or liable for damages, loss or injury resulting from entrants' participation in this Contest or the acceptance, possession, shipping and handling, loss, use or misuse of any prizes awarded in this Contest. Entrants and winners assume sole liability for injuries, including personal injuries and/or damage to property, caused or claimed to be caused by participating in this Contest or the acceptance, possession, shipping and handling, loss, use or misuse of any prize awarded. By entering this Contest, entrants agree to and hereby do (a) grant to Sponsor a worldwide, perpetual, irrevocable, right and royalty-free license to use the essay submitted in the Entry and, except where prohibited, entrant's name and hometown, all for any purpose specifically including but not limited to reproduction of the essay in part or whole, with our without modifications, on Sponsor's and/or its agents websites, on television, radio, publications and the Internet, on store signage, on Sponsor's gift cards, for promotional and advertising purposes in all media worldwide or for any other purposes without compensation to entrant, (b) irrevocably assign and transfer to Sponsor the right of ownership in the Entry submitted, (c) irrevocably assign and transfer to Sponsor all copyright rights in and to the essay included with the Entry, and (d) release Sponsor and its agents from any and all liability with respect to participation in the Contest and the acceptance, possession, shipping and handling, loss, use or misuse of any prizes awarded in this Contest. By entering this Contest entrants also agree to be bound by the Official Rules and the decisions of the judge, and to be contacted by Sponsor by mail, email, and/or telephone concerning this Contest. By accepting a prize, winner consents to the use of his or her name and hometown and the essay submitted in the Entry, for promotional and advertising purposes in all media worldwide without compensation to entrant, except where prohibited by law. All applicable federal, state and local laws and regulations apply. VOID IN THE U.S. VIRGIN ISLANDS, U.S. MILITARY INSTALLATIONS IN FOREIGN COUNTRIES, AND WHERE PROHIBITED.
6. Applicable Law: This Contest is governed by the laws of the United States and all claims must be resolved in the United States. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion but in no event attorneys' fees; and entrant hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
7. Winners List: For a list of winners send a self-addressed, stamped envelope to be received by August 22, 2008 to: "2008 Garden Fresh Essay Contest Winners List," c/o Garden Fresh Restaurant Corp., 15822 Bernardo Center Drive, Suite A, San Diego, CA 92127-2320. Vermont residents may omit return postage.
